Terms of Use

1. Research tool only — no betting advice

Edgewise Terminal ("the Service") is a statistical research and analytics platform. It produces probability estimates, model outputs and historical analyses for informational and educational purposes only. The Service does not accept wagers, does not place bets on your behalf, and does not constitute betting, financial, legal or tax advice. Nothing presented in the Service is a recommendation to place any wager.

2. Eligibility — 18+ only

You must be at least 18 years of age and physically located in a jurisdiction where use of statistical sports research tools is lawful. By using the Service you confirm you meet these requirements. We reserve the right to terminate access without notice if eligibility cannot be verified.

3. Responsible gambling

Gambling can be harmful. If you or someone you know needs help, contact Gambling Help Online (1800 858 858) or register with the national self-exclusion register at BetStop.

4. Acceptable use & prohibited conduct

• Do not scrape, resell, or redistribute Service data.
• Do not use the Service to facilitate unlawful wagering or money laundering.
• Do not attempt to bypass authentication, rate limits, or access controls.
• Do not reverse-engineer, decompile, or commercially repackage the Service or its model outputs.
• Do not engage in any illegal activity through the Service.

5. Disclaimer & limitation of liability

The Service is provided "as is" and "as available". To the maximum extent permitted by Australian Consumer Law, we exclude all warranties (express or implied) regarding accuracy, fitness for purpose, or uninterrupted availability. Probability outputs are estimates and may be wrong. You assume full responsibility for any decisions you make.

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or in connection with the Service is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater. We are not liable for indirect, consequential, or gambling-related losses, including any losses arising from wagers you place with third parties based on information obtained from the Service.

6. Subscriptions & payments

• Pro: $79 AUD per month.
• Enterprise: $149 AUD per month.
• Trial: 14-day trial available on paid plans.
• Billing: processed by Stripe; we do not store full card numbers.

Paid plans are billed in advance and renew automatically until cancelled. You may cancel at any time from your account settings; access continues until the end of the current billing period. Refunds are governed by the non-excludable rights granted under Australian Consumer Law.

Refunds & chargebacks: outside the non-excludable rights under Australian Consumer Law, subscription fees are non-refundable once the billing period has begun. Initiating a chargeback without first contacting us at edgewiseplatform@gmail.com may result in immediate account suspension while the dispute is investigated.

Price changes: we may change subscription pricing with at least 30 days' notice by email. Continued use after the effective date constitutes acceptance of the new price.

7. Compliance — ACMA & NT

The Service is operated from Darwin, Northern Territory, Australia. We comply with the ACMA regulatory framework for online services and the requirements of the Northern Territory Racing Commission.

8. Governing law

These Terms are governed by the laws of the Northern Territory, Australia. The exclusive courts of competent jurisdiction are those of Darwin, NT.

9. Account suspension & termination

We may suspend or terminate your account, without refund, if you breach these Terms, engage in fraudulent or unlawful conduct, attempt to abuse trial periods, or place the Service or its other users at risk. You may close your account at any time from account settings; closure does not entitle you to a pro-rata refund of the current billing period.

10. Intellectual property

The Service, including all software, models, probability outputs, UI, branding and documentation, is owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own internal research. You retain ownership of the ledger data you upload; by uploading it you grant us a worldwide, royalty-free licence to host, process and use it in anonymised, aggregated form to operate and improve the Service.

Feedback: any suggestions or feedback you provide may be used by us without obligation or compensation.

11. Third-party services & data

The Service displays market data, scores and links sourced from third parties (e.g. OddsAPI, sports data feeds). We do not control those sources and make no warranty as to their accuracy, timeliness or availability. Use of any third-party website you reach through the Service is subject to that website's own terms.

12. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or any wager you place with a third party in reliance on Service outputs.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of upstream data providers, payment processors, hosting infrastructure, internet service providers, natural disasters, or acts of government.

15. Severability & entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior communications.
